1. Agreement to Terms

By downloading, installing, or using Bookmark RAG ("the Software"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Software.

2. License Grant

Free Version:

  • Limited to 50 indexed bookmark URLs
  • Personal, non-commercial use only
  • Non-transferable license
  • Limited to one installation per user

Pro Version:

  • Unlimited indexed bookmark URLs
  • Personal or commercial use
  • Non-transferable license tied to your email address
  • Can be activated on up to 2 devices simultaneously
  • Valid for lifetime use unless terminated

⚠️ Important: You may not redistribute, resell, or sublicense the Software. Each user requires their own license.

3. Your Responsibilities

When using Bookmark RAG, you agree to:

  • Comply with Laws: Use the Software in compliance with all applicable laws and regulations
  • Respect Website Terms: When scraping web content, comply with each website's Terms of Service and robots.txt
  • Authorized Access Only: Only scrape content you have permission to access
  • Reasonable Use: Do not use the Software for mass scraping, DDoS attacks, or other abusive purposes
  • No Illegal Content: Do not use the Software to store, index, or search illegal content

4. Web Scraping & Authenticated Content

You are solely responsible for:

  • Ensuring you have the right to access and scrape the websites you bookmark
  • Complying with the Terms of Service of third-party websites (Google, Notion, etc.)
  • Respecting intellectual property rights and copyright laws
  • Using the authenticated browser feature only for your own authorized accounts

🚫 Prohibited Uses:

  • Scraping content you do not have permission to access
  • Bypassing paywalls or access controls without authorization
  • Violating the Computer Fraud and Abuse Act (CFAA) or similar laws
  • Accessing others' accounts or credentials
  • Commercial scraping or data harvesting for resale

5. AI Models & Third-Party Software

Bookmark RAG uses the following third-party software:

  • Meta Llama 3.1: Licensed under the Meta Llama 3.1 Community License. Model weights are downloaded by you and are not bundled with the Software.
  • Ollama: Required for running AI models locally. You must install and maintain Ollama separately.
  • Playwright: Browser automation library (Apache 2.0 license)

By using these features, you agree to comply with the respective licenses and terms of these third-party components.

6. Payment & Refunds

Pro License:

  • One-time payment of $39 (or current listed price)
  • Processed securely through LemonSqueezy
  • Lifetime access to the Pro version
  • No recurring subscription fees

Refund Policy:

  • 30-day money-back guarantee if the Software does not work as advertised
  • Refunds must be requested within 30 days of purchase
  • Refund requests can be submitted via email to contact@bookmarkrag.com
  • Refunds are at our discretion and may be denied for abuse

7. Disclaimers & Limitations

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND.

We disclaim all warranties, express or implied, including:

  • Warranties of merchantability or fitness for a particular purpose
  • That the Software will be error-free or uninterrupted
  • That scraped content will be accurate or complete
  • That AI-generated responses will be accurate or reliable

Limitation of Liability:

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Software, including but not limited to:

  • Loss of data or bookmarks
  • Violations of third-party Terms of Service
  • Legal consequences of web scraping
  • Inaccurate AI-generated content
  • System crashes or data corruption

Our total liability shall not exceed the amount you paid for the Software.

8. Privacy

Your use of Bookmark RAG is also governed by our Privacy Policy. Please review it to understand how we handle your data.

9. Updates & Support

Software Updates:

  • We may release updates, bug fixes, and new features
  • Updates are optional but recommended
  • We reserve the right to discontinue support for older versions

Technical Support:

  • Email support is provided on a best-effort basis
  • Pro users receive priority support
  • We do not guarantee response times or resolution

10. Termination

We reserve the right to terminate your license if you:

  • Violate these Terms of Service
  • Use the Software for illegal purposes
  • Engage in abusive scraping or other prohibited activities
  • Attempt to reverse engineer or redistribute the Software

Upon termination, you must cease all use of the Software and destroy all copies.

11. Intellectual Property

Bookmark RAG and its original components are protected by copyright and other intellectual property laws. You agree not to:

  • Reverse engineer, decompile, or disassemble the Software
  • Remove or modify any copyright notices or proprietary markings
  • Create derivative works based on the Software
  • Use the Bookmark RAG name or logo without permission

12. Governing Law

These Terms are governed by Danish Law, without regard to conflict of law principles. Any disputes shall be resolved in the Danish Courts.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the "Last updated" date. Continued use of the Software after changes constitutes acceptance of the updated Terms.
